This upper-level seminar examines the legal, regulatory, and policy frameworks that shape the development and deployment of clean energy technologies for electricity generation in the United States, including wind and solar energy. We will study how federal and state laws and policies interact to advance (and sometimes delay) new energy technologies, as well as the roles and functions of energy and carbon markets, project finance, and other contracting mechanisms and incentives. Seminar topics will include energy storage, distributed generation, carbon capture, and the emerging challenges presented by data centers, with a focus on regulatory and transactional legal practice. Enrollment is limited to 14 students. Grading will be based on a seminar paper (25-30 pages), active weekly class participation, and a presentation. Students outside the JD/LLM program must obtain the instructor’s permission to enroll.
