Welcome to the heart of the criminal legal system. This course follows the action after arrest—charging decisions, bail, preliminary hearings, grand juries, plea bargaining, the right to counsel, speedy trial rights, and more. We study not just doctrine, but strategy, leverage, and how constitutional law plays out in real courtrooms.
Each class pairs readings from the casebook with hypotheticals designed to challenge your instincts and judgment. Think like a prosecutor. Think like defense counsel. Think like a judge. We bring these roles to life through class discussion—and through our (optional but recommended) visits to the Philadelphia Criminal Justice Center.
The Criminal Procedure: Investigations course is not required; the material does not overlap. The final exam is partial open-book. This is the course for students drawn to litigation, fascinated by criminal law, or just eager to see the law in motion. If you want to understand how prosecutions really happen, start here.
