The Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization (2022) overruled a half-century of precedent and transformed the U.S. legal and constitutional landscape. This seminar will explore the social movements, legal advocacy, and larger political context surrounding the case. We will examine the past, present, and future of movements for reproductive rights and justice, as well as anti-abortion advocacy and its relationship to broader conservative movements; the evolution of legal and constitutional arguments and strategies relating to reproduction; and the connections between these debates and battles over the future of secular, multi-racial democracy. Course materials will be drawn from scholarly literature across several disciplines, as well as audio/visual media and diverse legal sources. Students will have a choice between a take-away exam or final paper. The final paper may, with the instructor’s permission, be used to fulfill the senior writing requirement.

Perspectives on the Law Learning outcomes: Demonstrate an understanding of how the law affects, and is affected by, the individual course topic; Perform legal analysis in the context of the individual course topic; Communicate effectively on the legal and other aspects of the individual course topic; Demonstrate the ability to use other disciplines to analyze legal issues relevant to the individual course topic, including economics, philosophy, and sociology, as appropriate.

Public Interest Learning outcomes: Demonstrate a core understanding of the varied legal aspects of public interest law; Perform legal analysis in the context of public interest law; Communicate effectively on topics related to public interest law; Demonstrate an understanding of how public interest law is connected to and affected by a wide variety of legal and regulatory structures and doctrines.
