This course surveys the law governing the democratic process in the United States. It will explore both the constitutional and statutory framework of American elections and supplement the doctrine with insights from empirical political science. We will cover a wide range of topics, including the right to vote, vote denial and vote dilution, race and representation, election administration, regulation of political parties, campaign finance, and alternative democratic structures. A central aim of this course is to equip students to critically evaluate current issues in the law of democracy---such as felony disenfranchisement, voter identification laws, political and racial gerrymandering, ranked-choice voting, and election subversion---and chart a path forward.
