According to a recent study entitled Copyright Industries in the U.S. Economy, the Entertainment Industry (Film, TV, Live, Theatrical and other Copyright Industries): • added $1 Trillion to the U.S Economy; • accounted for 6.5 percent of the total U.S. GDP; • employed 5.4 million workers in the United States; and • accounted for $142 billion in foreign sales and exports, more than such sectors as food and agriculture. In essence, the Entertainment Industry is big business and one of the United States most important exports, both culturally and financially. The study of Entertainment Law covers multiple legal disciplines including Intellectual Property, Contracts, Torts, and Labor Law. We will review and apply these traditional legal principles to specific entertainment industries including Music, Television, Film, Merchandising, Live Concert/Broadway, and Digital. This course is intended to approach the study of Entertainment Law from a practical perspective to better understand best business practices in legal negotiations. In accordance with the following, we will be participating in live negotiations and drafting sessions throughout the semester with a focus on key components/clauses of entertainment transactions and agreements. Some of the entertainment transactions we will be reviewing include the following: • Endorsement deals • Personal releases • Management and Agency agreements • Music Recording agreements • Music Publishing agreements • Television series contracts [Scripted and Reality TV] • Broadway agreements • Live Concert/Festival agreements • Merchandise deals • Digital exploitation contracts We will review how modern technology and digital media has affected the industry as a whole, including negotiations and legal contracts. This course will also examine current disputes and litigations that affect the Entertainment Industry. The goal of this course is for students to apply traditional legal principles to Entertainment Industry-specific agreements and/or disputes, and for students to gain knowledge of the types of traditional entertainment contracts that are negotiated within the industry.
