Rules of evidence are applied in all types of dispute resolutions. Trials have more strict ones; other forms of resolution may have more relaxed ones. This course will focus on the rules of evidence for court trials. We will focus on the Federal Rules of Evidence because they serve as a model for the rules in most states. We will cover questions of relevance (“What does this evidence have to do with this dispute?”), character (“When should information about someone’s past be considered?”), hearsay, authentication of evidence, and privilege (rules that exclude potentially relevant evidence). Even if you do not become a litigator, questions of attorney-client privilege may become important when advising a corporation you represent
The class will be a mix of the Socratic method and lecture for background. Classes will be problem-based with hypothetical questions to help you think through evidence issues. The grade will be determined by an end-of-semester final exam.
I will use a panel system to call on students. I will designate six students to be “on call” for each class. I will send an e-mail by Friday of the week before to give you notice.

Criminal Law and Procedure Learning outcomes: Demonstrate a core understanding of criminal law and procedure; Perform legal analysis in the context of criminal law and procedure; Communicate effectively on topics related to criminal law and procedure; Demonstrate an understanding of the role criminal law and procedure play in society and their impact on other areas of law and society.
