This course examines the functions, powers, and responsibilities of the federal courts, and their relationships with state governments and the federal government’s executive and legislative branches. Topics include justiciability; congressional authority over, and statutory and judge-made limits on, the jurisdiction of the federal courts; U.S. Supreme Court review of state court judgments; federal common law; suits challenging state and federal government action, and immunities asserted in such suits; and federal habeas corpus.
Courts and the Judicial System Learning outcomes: Demonstrate a core understanding of both substantive and procedural issues in the operation of our legal system; Perform legal analysis in the context of procedural issues and the judicial process; Communicate effectively on topics related to procedure and the judicial process; Demonstrate an understanding of how procedural issues and the judicial process affect all other area of our legal system.
