Led by two former federal prosecutors who currently practice in this area, in the first part of the course, students explore the legal frameworks advanced by key regulators, critiques and tensions among these competing claims of authority and legal theories, and practical challenges associated with litigation involving emerging digital technologies. In the second portion of the course, students will write and argue a motion for summary judgment based on a real-life civil enforcement case study, and students will receive feedback on their written work product and oral advocacy skills. This year’s class will work through examples surrounding DeFi, crypto, and other blockchain-fueled financial innovations --a recent focus of law enforcement and regulators, including the Department of Justice, Treasury, SEC, CFTC, and numerous other state and federal agencies.
