Higher Education Law and Policy
This course introduces students to the legal framework governing universities and colleges in the United States, exploring the rights and responsibilities of institutions, faculty, staff, and students. Students will explore important statutes, cases, and legal concepts applicable to American institutions of higher education. Key topics include government support for, and restrictions on, higher education institutions, academic freedom, Title IX, student rights, faculty employment, university finances, and the legal implications of issues like affirmative action and intellectual property. Additionally, the course gives the opportunity to consider the role of “in house” counsel and will include guest lectures and class visits from various attorneys and officials working with or involved with universities and colleges. The course also will explore the role of higher education in today’s society and the policy and social debates that inhere around issues of higher education in this country and (to a limited extent) other countries. The course format will include lecture and class discussion. Grading will be by final examination, although a “paper option” is likely if enrollment size is not too large. Students will have the option of taking a 4-hour final exam or writing an individual paper for the course grading requirements.
