This course covers medical liability issues arising from the relationship between health care providers and their patients. We will begin with an introduction to the law of negligence, generally. Topics in this area will include concepts such as legal duty, causation, general defenses and available damages. Once we learn these foundations, we will shift to more specific issues involving medical malpractice. Topics here will include the history of the medical malpractice tort, its evolution as a "crisis," informed consent, the framework for a medical malpractice lawsuit, alternative dispute resolution, and trial work.
