Originalism and Its Discontents – Seminar Spring 2025

Originalism is a leading method for constitutional and legal interpretation. Although heavily criticized in academia, a majority of Supreme Court justices and many lower court judges self-identify as originalists. This reading group offers students interested in the topic to learn about originalism—its evolution, its strengths and weaknesses, and its future.

The group will meet on Tuesdays from 2:20 to 4:20 p.m. to discuss the assigned readings. Students will have to write four reflection papers throughout the semester unless they arrange to write a longer research paper.

Constitutional Law Learning outcomes: Demonstrate a core understanding of constitutional law; Perform legal analysis in the context of constitutional law; Communicate effectively on topics related to constitutional law; Demonstrate an understanding of constitutional law affects other areas of law.
