This course is designed to be an intensive seminar examining the basics of litigating patent disputes in a United States District Court. We will endeavor to cover the start-to-finish of a patent case, from the drafting of the Complaint and Answer, through proceedings for injunctive relief, fact and expert discovery (including discussion of some international discovery issues), “Markman” claim construction proceedings, dispositive motions practice, trial, and post-trial proceedings. Reference will be made to parallel proceedings, but PTAB practice is not central to the course. Because we will be covering a lot of ground, coverage will necessarily be broad and not deep and, fair warning, we will surely not cover every topic in the detail we might like. We will move quickly, but hopefully will identify points of particular interest to discuss in some detail. Student preparation will be essential for each day’s class to be productive and interesting. This course will be graded credit/fail.
