This is a course about being a practicing lawyer in the real world. We will focus on the issues of professional responsibility that confront civil litigators every day of their careers. From obtaining clients, determining whether you can represent them, and getting paid, to handling cases zealously yet ethically in discovery and in court, to navigating your duties in settlement and during trial, we will follow your role throughout the life cycle of a case. Along the way, we will explore how the rules vary when representing plaintiffs or defendants, working in small offices or large firms, practicing locally, nationally, or globally, and litigating individual cases or class actions.
Professional Responsibility and Ethics Learning outcomes: Demonstrate an understanding of how the law affects, and is affected by, the individual course topic; Perform legal analysis in the context of the individual course topic; Communicate effectively on the legal and other aspects of the individual course topic; Demonstrate the ability to use other disciplines to analyze legal issues relevant to the individual course topic, including economics, philosophy, and sociology, as appropriate.
