In this seminar, students will explore racism in the United States from historical, comparative, and transnational perspectives. Students will come to understand the system(s) of oppression that have engendered anti-racism resistance in the past and that continue to engender resistance today. The shared texts and audiovisual materials focus on the historical interdependence of legal, economic, and political institutions (rules and practices) that constitute “structural racism” and that enable and sustain white supremacy, as well as adjudication of anti-racism claims from racial minorities in the United States. Students will read and analyze the rationales in the judicial opinions. Students will also engage legal archaeologies of these claims: who are the aggrieved individuals and groups, civil rights organizations, cause lawyers academics, and judges involved in each case. Students will complete five (5) short response papers to the course materials throughout the term. Additionally, students will complete an in-depth review of mobilization – including legal mobilization – against structural racism, especially mobilization by Black women and by indigenous, Asian, and Hispanic/Latinx people on the U.S. mainland an in U.S. colonies and occupied territories.

Courts and the Judicial System Learning outcomes: Demonstrate a core understanding of both substantive and procedural issues in the operation of our legal system; Perform legal analysis in the context of procedural issues and the judicial process; Communicate effectively on topics related to procedure and the judicial process; Demonstrate an understanding of how procedural issues and the judicial process affect all other area of our legal system.

Criminal Law and Procedure Learning outcomes: Demonstrate a core understanding of criminal law and procedure; Perform legal analysis in the context of criminal law and procedure; Communicate effectively on topics related to criminal law and procedure; Demonstrate an understanding of the role criminal law and procedure play in society and their impact on other areas of law and society.

Public Interest Learning outcomes: Demonstrate a core understanding of the varied legal aspects of public interest law; Perform legal analysis in the context of public interest law; Communicate effectively on topics related to public interest law; Demonstrate an understanding of how public interest law is connected to and affected by a wide variety of legal and regulatory structures and doctrines.
