This seminar examines selected topics and cutting edge issues related to the prosecution and defense of white collar crime. It provides an overview of the range of federal statutes that define individual and corporate crimes. The seminar will provide students with an understanding of how federal prosecutors and law enforcement agencies investigate white collar criminal matters and how defense lawyers defend clients facing such charges. The course will explore charging decisions, plea negotiations, and sentencings in white collar crime cases with an emphasis on wire and mail fraud, theft of honest services, insider trading and securities fraud and violations of the Foreign Corrupt Practices Act. Drawing on the substantial experience that Professors Matt Fishbein and Jacquelyn Kasulis have had in every aspect of the prosecution and defense of significant white collar crime cases, this course provides practical insights and guidance to students who may be interested in pursuing careers as prosecutors, public defenders, or criminal defense attorneys.

Course Policies-

Attendance: Mandatory.

Grading: The grade in the course will be based on attendance, class participation, and written work: 50% on attendance, class participation, and weekly, written observations/comments on the reading (several paragraphs); and 50% on three short (3-5 pages) papers).

Class Participation: Mandatory. This is a seminar class and student participation drives the discussion. This is not a faculty led lecture course.
